TERMS & CONDITIONS for LEADEVOLUTION USERS

Leads Pro Systems will provide LeadEvolution lead generation software and other related services to you, our Customer, under the following terms:

REFUND AND CANCELLATION POLICY - Updated January 10, 2010
Lead Evolution license is a downloadable, fully functional license. If you purchase our product, after your payment is cleared, you will receive a registration key to unlock the software. Due to the nature of downloadable software, as well as the proprietary information given on our methods on our private access site, NO REFUNDS will be accepted if leads have been exported and downloaded to your computer. You may receive a refund if you respond with 30 days at time of purchase, and show adequate proof that you used the software and made a valiant attempt to use it. If you use Lead Evolution 2, and schedule a coaching appointment, any coaching fees will be subtracted from refund owed. There is NO EXCEPTIONS to this. Do not purchase Lead Evolution if you do not agree to a $200 cancellation fee. If you have difficulty downloading the software, please contact our Tech Support to resolve your issue.

Here at Lead Evolution we have had incredible success stories, but we cannot guarantee your success, as you are ultimately responsible for your own success and failure. Please watch the webinar demonstrations or contact a sales representative at 1-888-719-3121 if you have
questions before purchasing Lead Evolution. Please do not purchase Lead Evolution if your current budget does not allow it. No product is a "magic bullet" - you are responsible for your dedication, flexibility, perserverance and creativity.

Lead Evolution reserves the right to modify this Refund Policy at its discretion, or against any customer it believes is abusing this policy. Any such revision or change will be binding and effective immediately after posting of the revised Refund Policy on visibility mobile's websites. You agree to periodically review our Web sites, including the current version of our Refund Policy. Our refund policy is made available on our Web sites. It is your obligation to review
our refund policy for any such revisions.

CANCELLATION POLICY
As you can cancel your membership at any time, subscription fees are not refundable. Please make sure to cancel your membership at least 1 business day before the time of your next billing date to avoid additional charges to your account. Cancellations must be submitted on
our help desk. You may cancel at anytime with 30 days advance notice to your next billing period. Upon notification of cancellation, Leads Pro Systems will immediately stop charging your credit card and no additional future charges will occur. Your subscription will remain
active until the end of the current subscription period already paid for and in effect.

AUTOMATIC RENEWALS
You agree to be charged at the time of subscription based on the type of plan you have selected. Your subscription will be renewed automatically and billed to your credit card at the beginning of each subscription period until you cancel the service. You may cancel at
any time by following the procedure described in our Cancellation Policy. The monthly subscription plans are renewed on 30-day intervals.

NO UNLAWFUL OR PROHIBITED USE
You acknowledge that Leads Pro Systems, Inc does not regulate or take any responsibility for the content of information, files, images, or other communication transmitted to or by Leads Pro Systems, Inc. You warrant that you have all rights necessary to lawfully submit or publish any information or material that is uploaded to LeadEvolution, including all intellectual property rights.

You agree not to publish or transmit any unlawful, harmful, threatening, abusive, harassing, defamatory, or racially or ethnically derogatory content, or any content expressing hate towards any person or groups of persons due to race, religion, color, creed, national origin or sexual orientation. You agree not to upload, post, email, transmit or otherwise make available any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of illegal solicitation. You agree not to upload, post, email, transmit or otherwise make available any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment. You agree to indemnify Leads Pro Systems, Inc against actions brought by a third party as a result of such material or information or transmission, or as a result of your use in any way of the services provided by Leads Pro Systems, Inc.

ACCOUNT, PASSWORD AND SECURITY
You agree to use a secure and standard web browser such as Microsoft Internet Explorer, Netscape Navigator, Firefox to access Lead Evolution members site. You must have an internet connection to use the LeadEvolution software program.

When you open your account, you will be able to choose a login ID and password. You are responsible for maintaining the confidentiality of your login ID and password. You are also responsible for all uses of your account, whether or not actually or expressly authorized by you. You have permission to put the LeadEvolution Software on only two computers. This is monitored and abuse of this policy will result in cancellation of your account.

You agree not to use LeadEvolution in any manner that could damage, disable or impair any of Leads Pro Systems, Inc servers, computer systems or network, or interfere with any other party's use and enjoyment of LeadEvolution, or any of Leads Pro Systems, Inc software applications or services. You agree not to attempt to gain unauthorized access to any of Leads Pro Systems, Inc software applications or services, other accounts, servers, computer systems or networks. You agree not attempt to obtain any materials or information not intentionally made available through LeadEvolution, or to reverse engineer, decompile, or disassemble the software code. You may not use anyone else's account at any time, without the permission of Leads Pro Systems, Inc.

You retain ownership of all your data, created by you and rightfully belonging to you, while properly accessing LeadEvolution under your login ID. Leads Pro Systems, Inc respects your privacy, and will not use, sell, rent, trade or otherwise disseminate or disclose your data to itself or any third party, except as required by law or by your authorized written request or consent.

TERMINATION
If, at any time, we, Leads Pro Systems, Inc, believe you, the Customer, are in breach of any of the terms and conditions contained in this agreement, we may immediately terminate this agreement, and your use of the software, without liability.

NO WARRANTIES
Leads Pro Systems, Inc makes no warranties of any kind, whether express or implied, for the services to be provided hereunder.

You, agree that Leads Pro Systems, Inc shall not be liable for any losses or damages of any kind to you including, but not limited to, those that may result from service interruptions, delays, non-deliveries, or mis-deliveries. Additionally, Leads Pro Systems, Inc makes no warranties regarding its ability to recover any lost data, lost files, or other information, regardless of how or why the data or file was lost.

BILLING POLICIES
You agree to provide accurate and up-to-date contact information to Leads Pro Systems, Inc, at the time you open your account, and as long as you use your account or it is active. You may contact customer service at admin@leadprosystems.com with any questions. Leads Pro Systems, Inc respects your privacy, and all your information is kept secure and confidential.

You agree to submit any and all payments due to Leads Pro Systems, Inc in US funds for billing upon receipt. Any past dues accounts, or accounts where any maintenance fees (If applicable to your account) are not paid are subject to suspension or termination and a service resumption fee. Cancellation of an account will result in deletion of all of Customer's files, including email. You agree that submission of credit card information to Leads Pro Systems, Inc constitutes authorization by you to bill the specified credit card for all fees owed by you to Leads Pro Systems, Inc.

LITIGATION AND ATTORNEY'S FEES
In the event of any dispute arising out of or relating to this agreement, such dispute shall be resolved in the State of California, County of San Diego, and the prevailing party in any such dispute shall be entitled to reasonable costs, including collection costs, and attorney's fees.

ENTIRE AGREEMENT AND SEVERABILITY
This represents the complete agreement and understanding between Leads Pro Systems, Inc and Customer with respect to the subject matter herein. In the event that any term or provision of this agreement is held by a court to be unenforceable, then the remaining provisions shall remain in full force and effect.
